These Terms of Use (“Terms”) govern your access to and use of HarvestLocal, including harvestlocal.ai and related services operated by HarvestLocal LLC (“HarvestLocal,” “we,” “us,” or “our”). By accessing or using HarvestLocal, you agree to these Terms and any policies incorporated by reference.
If you do not agree to these Terms, do not use HarvestLocal.
HarvestLocal provides an online marketplace that helps buyers discover and purchase products from independent local sellers. Unless we expressly state otherwise for a particular product, HarvestLocal is not the producer, manufacturer, packer, preparer, or owner of products listed by sellers.
Sellers are independent businesses or individuals and are responsible for the products they list, their descriptions, pricing, inventory, pickup arrangements, permits, licensing, labeling, food-safety obligations, taxes, and compliance with applicable law.
You must be legally capable of entering into these Terms, or use HarvestLocal with the involvement and permission of a parent or legal guardian.
Users ages 13 through 17 may use HarvestLocal only with the permission and supervision of a parent or legal guardian. Users under 13 may not create or independently use a HarvestLocal account at this time.
You are responsible for providing accurate information, maintaining the confidentiality of your account credentials, and all activity conducted through your account. You must promptly notify HarvestLocal if you believe your account has been compromised.
We may suspend or restrict an account when reasonably necessary to protect users, investigate misuse, comply with law, enforce these Terms, or protect the integrity of the marketplace.
When you place an order, you are offering to purchase the listed products subject to availability and the seller’s fulfillment obligations. Prices and availability may change before an order is completed.
Payments are processed through Stripe and may be subject to Stripe’s terms and privacy practices. HarvestLocal may collect marketplace fees from sellers or otherwise facilitate transfers between buyers, sellers, and payment providers as disclosed through the service.
An order is not complete merely because a checkout page was opened. Payment status and the order status shown in HarvestLocal determine whether an order has been accepted and paid.
HarvestLocal primarily facilitates local pickup. Buyers are responsible for reviewing the pickup location, date, time window, and instructions associated with an order. Sellers are responsible for making purchased products available according to the confirmed pickup terms.
Buyers and sellers should communicate promptly if a pickup issue arises. Products that are perishable, temperature-sensitive, or time-sensitive may be subject to additional pickup limitations disclosed by the seller.
Cancellations and refunds are governed by the HarvestLocal Refund & Cancellation Policy, seller-specific terms displayed with a listing or order, and applicable law. Some products may not be eligible for cancellation or refund after preparation, pickup, or another disclosed cutoff.
Where HarvestLocal processes a refund, payment processing timing and the appearance of funds in a buyer’s account may depend on Stripe, the buyer’s financial institution, and the payment method used.
Sellers must provide truthful, accurate, and non-misleading information about products, pricing, ingredients or characteristics where applicable, availability, pickup, and business identity. Sellers may not list prohibited, unlawful, unsafe, counterfeit, recalled, or misrepresented products.
HarvestLocal may review, reject, remove, or request changes to listings, but review does not constitute a guarantee, certification, inspection, or endorsement of a seller or product.
Additional seller obligations will be governed by the HarvestLocal Seller / Marketplace Agreement.
Food and other products sold through HarvestLocal are provided by independent sellers. Sellers are responsible for complying with applicable food-safety, labeling, licensing, permitting, allergen, storage, preparation, and sale requirements.
Buyers are responsible for reviewing product information and contacting the seller when they have questions about ingredients, allergens, handling, preparation, or suitability. If you have a serious allergy or medical dietary restriction, do not rely solely on marketplace descriptions.
You may not misuse HarvestLocal; interfere with the service or another user’s account; attempt unauthorized access; scrape or harvest personal information except as permitted by law and these Terms; upload malicious code; engage in fraud or deceptive conduct; use the service to violate law; or use buyer information obtained through HarvestLocal for unauthorized marketing, resale, or unrelated purposes.
You retain ownership of content you submit, such as seller descriptions and product photos, subject to any rights you have in that content. By submitting content to HarvestLocal, you grant HarvestLocal a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and use that content as reasonably necessary to operate, promote, and improve the marketplace.
HarvestLocal’s name, branding, software, design, and service content are owned by or licensed to HarvestLocal and may not be copied or used except as permitted by law or with our authorization.
We may modify, suspend, or discontinue features, listings, or portions of the service. We do not guarantee that HarvestLocal will always be available, error-free, or uninterrupted. We may perform maintenance, deploy updates, or limit access when reasonably necessary for security, legal, or operational reasons.
To the fullest extent permitted by law, HarvestLocal is provided on an “as is” and “as available” basis. HarvestLocal does not make warranties about the quality, safety, legality, accuracy, availability, or suitability of products offered by independent sellers, or about a seller’s compliance with law.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
To the fullest extent permitted by law, HarvestLocal LLC and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the service or a transaction between buyers and independent sellers.
To the fullest extent permitted by law, HarvestLocal’s aggregate liability arising from or relating to the service or these Terms will not exceed the greater of the amount you paid directly to HarvestLocal during the twelve months before the event giving rise to the claim or $100. This limitation does not apply where applicable law prohibits it.
To the extent permitted by law, if you use HarvestLocal as a seller or misuse the service, you agree to defend, indemnify, and hold harmless HarvestLocal LLC and its officers, employees, and affiliates from third-party claims, losses, liabilities, and reasonable costs arising from your products, listings, conduct, violation of law, or violation of these Terms. This section does not require a consumer to indemnify HarvestLocal for HarvestLocal’s own unlawful conduct.
These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise. Any court proceeding that is not subject to a different mandatory venue under applicable law may be brought in a state or federal court with jurisdiction over Dawson County, Nebraska.
We may update these Terms as the service evolves or applicable law changes. For material changes, we may provide notice through the website, account communications, email, or another appropriate method. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.
